An important priority of DigitalDarts.com.au (the “Website” or “we” or “us” or “our”), and of the software applications and tools we publish, including apps we distribute through third-party marketplaces such as the Shopify App Store (the “Apps”), is to abide by the law in relation to the privacy and handling of any collected data of our customers, visitors, users, and other individuals who use, engage or otherwise access the Website and/or the Apps (together the “Users” or “you” or “your”). This Privacy and Cookies Policy (the “Policy”) explains what information we collect on the Website and through the Apps, how we use, share, protect and secure it, and how you can access it or contact us with questions or concerns.
By accessing or using the Website or the Apps, you confirm that you have read this Policy and understand your rights in relation to any collected information. If you do not agree with this Policy, please discontinue your use of the Website and the Apps.
2. What Types Of Information Do We Collect From You?
Whenever a User visits or engages with the Website, installs an App, or requests information about the services, we collect different types of information:
2.1 Generic Information
This is information we gather from Users in an automated fashion. Users remain anonymous to us and we cannot identify them personally. This may be done by recording a simple visit or browsing activity on the Website or the Apps, at times through a third-party service such as analytics and similar tools.
Additionally, this may be done through server logs and/or cookies. THIS SITE USES COOKIES. Cookies are used as part of gathering generic information from Users and browsers, and may be stored on the device you use to access the Website or interact with the Apps, unless you disallow, prevent or otherwise block them. Advertisements appearing on the Website are delivered by us or by one of our advertising partners, and such partners may store cookies on your computer. These cookies are used for purposes such as delivering targeted advertisements the advertiser feels may be relevant to you, and advertisers may collect additional information such as the approximate geographical location of your device. This Policy governs the cookies used by the Website; it does not govern cookies used by advertisers.
When using publicly available parts of the Website, such as commenting on articles, you may optionally disclose personal information. Use judgment and caution in doing so: we are not responsible for, and have no control over, that disclosure, and we are not liable for anyone’s use or misuse of information you disclose publicly.
2.2 Identifiable Personal Information
You may need to enter personal information in a form, depending on the service you require, to use the Apps, when subscribing to our newsletter, or when entering any promotions offered on the Website. Information you share with us willingly includes:

- Names
- Location
- Website URL
- Payment information
- Mobile and/or telephone number
- Shopify store URL and the email address associated with the Shopify store
- Support correspondence you send us
3. How Do We Use The Information That We Receive From You?
- We use the identifiable information we gather to provide you with information about our services, and to provide those services to Users who have engaged us, including operating the Apps on the stores where they are installed.
- Your phone number may be used to communicate messages or information to you, or to ask about your interest in an available offer.
- If you do not wish to be contacted by phone or by post or courier, you can leave clear instructions via the contact page. You may still need to leave your e-mail address.
- A User’s e-mail address is not shared with or displayed to anybody outside the Website.
- To combat online fraud and secure our services, we record your IP address and other generic information received from your browser in our server logs, including cookies and the pages you request.
- You consent to your information being combined with the information of other Users, without personally identifying you, and shared in that aggregated form with our business partners or others.
- We may send you administrative messages and e-mail updates regarding your account or any service you have joined, visited or contacted.
- To operate the Apps, we use service providers for hosting, webhook delivery, transactional email, and AI-assisted support tooling used by our staff to answer support requests. Where we process personal data on your behalf in connection with an App and applicable data protection law requires it, our Data Processing Agreement applies, including its list of the sub-processors involved. - Google’s use of various cookies serves ads to Users based on their visit to the Website and other sites on the Internet. You may opt out of the DART cookie via the Google advertising privacy and terms. These cookies allow Google to serve ads to you based on data regarding your Internet activity and browsed sites; third-party cookies may also be used pursuant to Google’s policies. You can opt out or change the settings of these cookies at https://myadcenter.google.com/.
- Facebook and Bing also use cookies for behavioral targeted advertising. If you do not wish to be targeted by such advertisements, you can opt out at https://accountscenter.facebook.com/ads/ and/or https://help.ads.microsoft.com/#apex/3/en-us/51029.
- We use the services of Drip on some of the forms available on the Website, and for email campaigns you consent to when subscribing to our offers or newsletters. You can access Drip’s privacy and cookie policies at https://www.drip.com/privacy.
- We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. - We may need to provide your personal information to third parties in order to deliver specific services to you, such as support services or payment processing. These third parties are required not to disclose your personal information and not to use it for purposes other than providing the services we request.
- We may disclose personal information if required by law, a subpoena, or other judicial or administrative orders, or where we deem it necessary to protect the safety of any individual or the general public, or to prevent violation of our Terms of Service or the rights of us or any third party.
- If a merger, acquisition, change of ownership, or sale of assets to another entity occurs, we reserve the right to transfer User information, including names and e-mail addresses, to that entity. We will notify Users of such a transfer by a message on this site or by e-mail, and you may update your registration information or cancel your account at that time if you are concerned about your information transferring to a new owner.
3.1 How Long Do We Keep It?
We keep personal information for as long as your account is active or as needed to provide the services, and afterwards only as long as required for legitimate operational or legal purposes. When you uninstall an App, data associated with your installation is deleted or de-identified within the retention windows described in our Data Processing Agreement; merchant contact details in operational records are redacted when the platform sends us a deletion or redaction request.
4. With Whom Do We Share Your Information?
Except in the situations described in Section 3, namely service providers, legal requirements, and business transfers, we do not share your identifiable information with third parties. To provide the services and improve parts of our Website, some generic information is shared with third parties. To our current knowledge, these parties comply with applicable privacy and cookie regulations.
5. How Do We Protect Users’ Data and Information?
We are committed to making reasonable efforts to protect our servers and databases, using security and encryption measures to attempt to keep Users’ information and personal data confidential and private. Even so, no website or application is 100% secure, and you acknowledge that despite our efforts, breaches may occur and information may be accessed, shared or used by malicious parties without our knowledge.
Data for the Apps is hosted on servers located in Germany, in the European Union. Where parts of your information are processed by a third party, that party is obligated to protect the personal data of Users of the Apps and the Website to the same or greater extent than this Policy.
6. What Is Our Policy On Children’s Privacy?
For all applicable legal purposes, we construe anyone under the age of 16 to be a child. We do not knowingly collect the information of children, and do not allow, encourage or otherwise sponsor the registration of minors under that age.
Whenever we become aware that identifiable information we have collected belongs to, or was submitted by, a child, we shall within a reasonable time:
- Not disclose the collected information to third parties, nor use it for any purpose;
- Delete the personal information from our files as soon as possible; and
- Be available to the child’s parents or legal guardian for any further requests regarding the collected information.
If you become aware that we may have collected data from a child under 16, please inform us so we can permanently delete it.
7. Are We Compliant With GDPR?
This section applies to Users in the European Union and the European Economic Area, and applies equally under the UK GDPR to Users in the United Kingdom. Users who do not fall under those descriptions also benefit from these provisions.
7.1 Principles pursued
- The amount of collected data is kept to the minimum needed to provide the services;
- We will inform you through your provided e-mail address of any changes made to this Policy;
- The system requires you to affirmatively consent to this Policy and our Terms of Service;
- As soon as we become certain of a data breach affecting your personal data, we will send an e-mail informing affected Users of the breach;
- All notifications, subscriptions, and other activities related to the services are set to the minimum by default.
7.2 Rights conferred

- Request access to the data we have collected from you;
- Request that the collected data be deleted, pursuant to your right to be forgotten;
- Request that your collected data be transferred to you in a digital, machine-readable format and, where technically feasible, transferred to a different data controller;
- Request rectification of any information collected from you that contains mistakes or has been misconstrued;
- Object to, or request the restriction of, our processing of your data;
- Withdraw any consent you have given, without affecting the lawfulness of processing before the withdrawal; and
- Lodge a complaint with a data protection supervisory authority.
Please allow our staff a reasonable amount of time to respond to any request under this Section 7.
8. We Reserve The Right To Modify This Policy
We may occasionally amend, change or update this Policy, either to improve it or to comply with new laws and regulations affecting the handling, collection and management of personal data. Changes to the Terms of Service or this Policy will be communicated through the User’s provided e-mail address.
9. International Transfers (EEA, UK and Switzerland)
Data for the Apps is stored in the European Union, as described in Section 5. Your personal information may nonetheless be transferred to, accessed from, or processed in locations outside the EEA, the UK or Switzerland, for example by our staff in Australia or by service providers in other countries. Where that occurs, we use appropriate safeguards recognised by applicable data protection law, such as adequacy decisions or the European Commission’s Standard Contractual Clauses, which for merchant data processed via the Apps are incorporated through our Data Processing Agreement, and we make reasonable efforts to ensure your information is treated in compliance with applicable privacy rules.
